Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of OpenDentist Notes ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

  • "Service" — the OpenDentist Notes web application and all related features.
  • "User" — any individual who registers for and uses the Service.
  • "Content" — all data, text, audio recordings, transcripts, and clinical notes created or uploaded through the Service.
  • "AI Output" — any text, clinical notes, summaries, or tasks generated by the Service's AI features.

3. Service Description

OpenDentist Notes is an AI-powered clinical note-taking tool designed for dental professionals. The Service uses speech-to-text and large language models to assist with clinical documentation. The Service does not provide clinical or medical advice.

4. Eligibility

The Service is intended for UK dental professionals. To register, you must hold a valid GDC (General Dental Council) registration number. Accounts are subject to admin verification of your GDC status before full access is granted.

5. Clinical Responsibility

AI-generated output is assistive only. The treating clinician retains full clinical and legal responsibility for all documentation and clinical decisions. You must review and verify all AI-generated notes before relying on them. OpenDentist is not liable for any clinical outcomes resulting from the use of AI Output.

6. Subscription & Billing

  • New accounts receive a 14-day free trial.
  • After the trial, continued access requires a subscription at £35/month.
  • All payments are processed securely through Stripe. We do not store your payment card details.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
  • We reserve the right to increase subscription fees once per calendar year. We will give you at least 30 days' written notice before any price increase takes effect. If you do not wish to continue at the new price, you may cancel before the increase applies.

7. Acceptable Use

You agree to use the Service only for:

  • Legitimate dental clinical documentation purposes.
  • Activities that comply with your obligations under the GDC, CQC, and all applicable laws and regulations.

You must not:

  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
  • Share your account credentials or allow others to access the Service through your account.

8. Intellectual Property

  • Your Content — you retain ownership of all clinical data and Content you create using the Service.
  • Our Platform — OpenDentist owns all rights in the platform, technology, branding, and software.
  • Template Store — templates shared via the Template Store are licensed to other users for their own clinical use.

9. Data Protection

We are committed to protecting your data in compliance with UK GDPR. For full details on how we collect, use, and protect your data, please see our Privacy Policy. Our data processing terms are incorporated into these Terms by reference.

10. AI & Accuracy

The Service uses artificial intelligence to generate clinical notes and related output. AI may produce errors, inaccuracies, or omissions. We make no guarantee of clinical correctness. It is your responsibility to verify all AI Output before use in a clinical context.

11. Availability & Support

We make reasonable efforts to keep the Service available but do not guarantee uninterrupted access. We do not offer a formal SLA. Support is available via support@opendentist.ai and our in-app live chat.

12. Limitation of Liability

To the maximum extent permitted by law, OpenDentist's total liability to you for any claims arising from or relating to the Service is limited to the fees you have paid in the 12 months preceding the claim. We are not liable for any clinical decisions made based on AI Output, or for any indirect, incidental, or consequential damages.

13. Indemnification

You agree to indemnify and hold OpenDentist harmless from any claims, damages, or losses arising from your misuse of the Service or your failure to review and verify AI Output before clinical use.

14. Termination

Either party may terminate the agreement at any time. You can cancel your subscription through the Service or by contacting us. Upon termination, you may request export or deletion of your data by emailing support@opendentist.ai. We reserve the right to suspend or terminate accounts that violate these Terms.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated with reasonable notice via email or a notice within the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
